نامه دختر سيامك پورزند به رهبر جمهوري اسلامي: "اگر خانه اي دارم، پيشكش شما"

Banafsheh Pourzand, 41, wrote that she would donate to the Leader the New York apartment her father allegedly bought for her with the $40,000 he allegedly confessed to have received from Reza Pahlavi. The letter directly challenges the judiciary by showing the confessions were obtained from her father by force. (Alireza Taheri, Golnaz Esfandiari) Democracy and the Islamic Republic's Constitution, Part 3 On the anniversary of the 1979 national referendum on establishing the Islamic Republic, four commentators and scholars of political thought comment on democracy in interviews with RFE/RL. * Javad Tabatabi, professor of political philosophy in Paris says the Islamic Republic Constitution is a paradoxical document. It makes concessions to public interest but lacks institutions and measures to carry them out. While many learned legal scholars expounded on Iran's old (monarchical), today's constitution is defined and taught by people who have no law education. Even their understanding of Islamic jurisprudence is very rudimentary. * Baqer Parham, a writer living in Paris, says the Guardians Council's oversight over the Majlis contradicts the people's right to sovereignty under the same constitution. * Javad Tabatabai says constitutions reflect the spirit of religion in every civilized country, but Article 4 of the Islamic Republic Constitution says all laws in Iran would have to be based on Islamic laws. That makes the Majles and legislation unnecessary. * Asghar Schirazi, Berlin-based author of "Constitutional Law in Iran" says the Islamic Republic Constitution suffers from the contradiction between its democratic aspects and the autocratic powers it gives the Supreme Leader. While the Islamic Republic Constitution borrows language, concepts and institutions from other systems of thought, including western democracy and socialism, it also embodies "Velayat-e Faqih," or government of the Islamic jurist, based on the theory that religion is perfect and has answers for every problem in human society. * Tehran-based writer Mohsen Sazegara, a former Revolutionary Guards official and publisher of Jame'eh, a banned reformist newspaper, says reason in the Islamic Republic Constitution is limited to theology. * Mohammad-Ali Ayazi, a Shiite theologist in Qum, says that while separation of powers exists in the Islamic Republic Constitution and Article 110 enumerates in detail the authorities of the Leader, in practice the law may not be fully observed. * Asghar Schirazi says Article 110 authorizes the Leader to intervene whenever he sees fit; and his decrees are above the law. * There is really no unelected office in the Islamic Republic, because even the Leader is elected by the Assembly of Experts, the members of which are elected by the people, says Mohsen Sazegara. So, the reformists' dichotomy of elected and unelected officials is not constitutionally accurate. * Musa Ghani-Nezhad, Tehran based writer of "Modernism and Expansionism" says elected bodies, such as the Majlis or the government, can be used to impose the will of a particular group on the people. * Sazegara says that the failure of the reformists in the past five years shows that the current Islamic Republic Constitution makes reforms impossible. Today we need to evaluate this constitution and amend it. British Museum Buys Six Turkman Sahra Paintings by Tatari * RFE/RL interviews painter Aneh-Mohammad Tatari from the Turkman Sahra area of Iran, who says his exhibit in London is about devotion. A curator of the Oriental department of the British Museum tells RFE/RL about the museum's purchase of six paintings by Tatari. (Mahmud Khoshnam) One Book, One Author: "Globalism or Re-Colonization" * Mohammad Mohammad, London-based professor of international relations, talks to RFE/RL's book reviewer, Bahman Bastani about the new book he co-wrote with Mohammad Ahsan.در ايران، نوشتن نامه- چه سر بسته و چه سرگشاده - به رهبران جمهوري اسلامي براي دادخواهي درباره زندانيان، به خصوص زندانيان سياسي-عقيدتي، تازگي ندارد. اين نامه ها كه بي استثنا، نشانه نگراني هاي عميق آميخته با درماندگي نويسندگان آن هاست، بيشتر از اين واقعيت سرچشمه مي گيرد كه نويسندگان نامه ها به قوه قضاييه جمهوري اسلامي يا دست كم به بخشي از آن هيچ گونه اعتمادي ندارند و داوري آن را نشات گرفته از اغراض سياسي مي دانند. آن ها در حالي اين نامه هاي معمولا سرشته با احساسات، پاكدلي و دادخواهي را مي نويسند كه مي دانند از مخاطبشان باحتمال قريب بيقين پاسخي دريافت نخواهند كرد. همچنان كه نامه اخير آزاده-فرزند سيامك پورزند، روزنامه نگار در بند، به رييس جمهوري اصلاحگراي ايران- تا كنون بي پاسخ مانده است. با اين حال، نامه بنفشه، ديگر فرزند سيامك پورزند، با نامه هاي ياد شده فرق عمده دارد. در اين نامه، بنفشه قوه قضاييه جمهوري اسلامي را صريحابه چالش فرا خوانده و كوشيده است تا نشان دهد كه اعترافات منسوب به پدرش، اعترافاتي است به زور گرفته شده، به درخواست بازجويان و در نتيجه بي پايه. بنفشه پورزند اين نامه را در حالي نوشته است كه بازداشت كنندگان سيامك پورزند به او اجازه داده و از خواهر او خواسته بودند تا به اعضاي خانواده تلفن كنند و عاجزانه بخواهند كه درباره پرونده او نه با راديويي گفت و گو كنند و نه نامه يي بنويسند. درخواستي كه اجابت نشد. استثنا بودن نامه سرگشاده بنفشه از اين واقعيت سرچشمه مي گيرد كه در اعترافات منسوب به سيامك پورزند از جمله آمده است كه او با دريافت چهل هزار دلار از شاهزاده رضا پهلوي، به جاي تبليغ پادشاهي در ايران، براي دخترش بنفشه در نيويورك آپارتمان خريده است. مدافعان حقوق بشر پس از انتشار اعترافات منسوب به سيامك پورزند بي درنگ يادآوري كردند كه با چهل هزار دلار به دشواري مي توان در تهران آپارتماني آبرومند خريد چه رسد به خريد آپارتماني در شهر گراني مانند نيويورك. ابراهيم نبوي طنز پرداز ايراني هم نوشت: اگر سيامك پورزند يك چنين پول هايي مي داشت چرا براي خودش يك ماشين تحرير درست و حسابي نخريد؟ نامه سرگشاده بنفشه به آيت الله خامنه اي رهبر جمهوري اسلامي نيز تاييدي است بر واكنش مدافعان حقوق بشر و نيش طنز آميز ابراهيم نبوي به اعترافات منسوب به سيامك پورزند. بنفشه مي نويسد: "اعتراف خريد آپارتمان براي من در نيويورك با پول دريافتي از آقاي رضا پهلوي واقعيت ندارد چون من كرايه نشين، صاحب هيچ ملكي در نيويورك نيستم. اگر در هر كجاي اين جهان ملكي به نام من پيدا شد آن را به شما پيشكش مي كنم." بنفشه پورزند خطاب به رهبر جمهوري اسلامي مي گويد: "آقاي خامنه اي! شما حتما پدر من سيامك پورزند را مي شناسيد. او از روز سوم آذر ماه در سال عدل علي در اسارت حكومت شماست. آجازه مي خواهم او را بيشتر به شما معرفي كنم. او تمام زندگيش را وقف فرهنگ ايران كرده است و از مال دنيا هيچ ندارد جز يك قلم شكسته.او نه تفنگ مي شناسد، نه كودتا و نه دلار، و اين را همه مي دانند." بنفشه پورزند در پايان نامه سرگشاده اش به رهبر جمهوري اسلامي ياد آوري مي كند: "آقاي خامنه اي! پدر من مي توانست مانند بسياري ديگر از ايران خارج شود و غربت را برگزيند اما او عاشق فرهنگ ايران است. او گناهي جز اين ندارد. پدرم در آن خاك و به عشق آن خاك شايد در اسارت شما بميرد اما بدانيد كه آن چه به روز او آورديد نامش را در فرهنگ و تاريخ ايران جاودانه خواهد كرد. "من عيد نوروز را به فرزندان شما تبريك مي گويم و اميدوارم كه آنان و هيچ فرزندي در ايران داغ اسارت ناجوانمردانه پدري را كه مهربان و فرتوت است را نبيند."

بنفشه پورزند، دختر سيامك پورزند، روزنامه نگار سالخورده كه بيش از 5 ماه است در بازداشت قرار دارد، در نامه اي خطاب به رهبر جمهوري اسلامي "اعترافات" نقل شده از پدر خود در جرايد داخل كشور را تكذيب كردو نوشت اگر مطابق اين اعترافات، خانه اي با دريافت 40 هزار كمك از شاهزاده رضا پهلوي براي وي در آمريكا خريداري شده است، حاضر است آن را به رهبر جمهوري اسلامي هديه كند. بنفشه پورزند در نامه خود قوه قضائيه جمهوري اسلامي را صريحا به چالش فراخواند و كوشيد تا نشان دهد اعترافات منصوب به پدر وي به زور گرفته شد و بي پايه است.
