The conservative Guardians Council has vowed to reject the bill. Conservative newspapers warn that the bill would mean absolute dictatorial power for the president, but reformists say it is the only way to bring the country out of the current political impasse. Nationalist-religious coalition member Mohammad Maleki, Tehran University's first post-revolutionary president, tells RFE/RL that the that the only way out of the impasse would be to a referendum on the constitution, since the bill would not solve the contradictions inherent in the constitution. But Tehran University political science professor Sadeq Zibakalam tells RFE/RL that rather than expanding presidential powers, which may be abused by an autocratic president in the future, the Supreme Leader and the institutions under his command must be made to be more responsive to the Majles. (Fereydoun Zarnegar) Factions Disagree on Saddam * While the reformists hope for a regime change in Baghdad to a pro-US democracy, the conservatives, including the revolutionary guards commander Rahim Safavi, warn Iraqi opposition groups not to cooperate with the US, according to the Financial Times' Tehran reporter Guy Dinmore. (Fariba Mavedat, London) Arab Press on Kuwaiti Defense Minister's Tehran Visit * Kuwaiti and other Arab press gave extensive coverage to Kuwaiti defense minister Sheikh Jaber Mubarak's visit to Tehran, but did not print any details of his talks with Iranian officials. London's al-Hayat wrote that Tehran seeks to sign defense pacts with all the Persian Gulf Arab countries. Alsharq-ol-Osat wrote that Iraq's isolation is bringing Tehran and the Persian Gulf Arab countries closer. (Farideh Rahbar, Cairo) Reaction to Public Hanging of Five Convicts * A day after the Tehran Judiciary hanged five convicts in public, Italian senator Sergio Beria, head of an anti-capital punishment NGO, called for the return of human rights observers to Iran in a letter to the head of European Commission. (Ahmad Ra'fat, Rome) * Paris-based political commentator Ahmad Salamatian tells RFE/RL that educating public opinion against capital punishment is the job of the elite, which is not being done by Iran's civil society advocates. He adds that public opinion in all countries, even those who have abolished capital punishment, favor execution of violent criminals as revenge and deterrent. (Mehdi Khalaji) Clashes with Police in Eslamshahr * Once again the Eslamshahr shantytown southwest of Tehran was the scene of a violent clash between residents and police and municipal government workers who had orders to level houses built without permits. Tehran-based journalist Hasan Fathi tells RFE/RL that twelve were wounded in the clashes, which are expected to spread to other shanty towns around Tehran where homeowners resist police efforts to bulldoze their properties. (Mahmonir Rahimi) Conservative Daily Prints Alleged Minutes of Reformists' Strategy Meeting * The conservative daily Keyhan printed details of what it said were minutes of two meetings of unnamed reformist officials planning for a mass walkout of at least 4000 top government officials in a protest against conservatives. (Siavash Ardalan) Majles Approves Bill to Reform Local Councils Election Law * Majles approved more provisions of the bill to reform the local councils' elections law. Reformists believe that the formation of high councils at provincial centers would resolve the problems faced by local councils. Election of the new local councils based on the new bill is scheduled for March 2003. (Jamshid Zand) Majles Sets a Lower Rate Base for Salaries of Women Civil Servants * In the first discriminatory bill ever to pass in the Majles, a lower salary rate base than that of married men was set for married women civil servants. Washington-based human rights activist Mehrangiz Kar tells RFE/RL that the lower rate is due to a provision of the civil code, based on Islamic law, that makes married men responsible for the payment of "nafaqeh" or alimony, to their wives, even though in many families today women are also breadwinners. Negative Reactions to IMF's Positive Report on Iran's Economy * In its annual report, the International Monetary Fund (IMF) found positive things about the direction of Iran's economy, such higher growth rate, the unification of the foreign exchange rate, lower inflation rate and decreasing foreign debt. (Jean Khakzad, Paris)فريدون زرنگار (راديوآزادي): با گذشت حدود يك هفته از ارائه لايحه تبيين اختيارات رئيس جمهوري به مجلس شوراي اسلامي گفتگو بر سر آن همچنان موضوع سياسي روز است . يكي از نمايندگان مجلس شوراي اسلامي ميگويد مجلس هنوز لايحه دولت را در اختيار نمايندگان مجلس قرار نداده است و محمد رضا خاتمي نايب رئيس مجلس ميگويد دليل چاپ و توزيع نشدن اين لايحه تصميم مجلس براي تشكيل يك كميسون مشترك براي بررسي اين لايحه است . نگرش به اين لايحه از زاويه هاي مختلف صورت ميگيرد. اصلاح طلبان ارائه اين لايحه را روزنه اي براي خارج شدن از بن بست سياسي نظام ارزيابي ميكنند در حاليكه بين محافظه كاران برخوردي دوگانه به اين لايحه در حال شكل گيري است . گروهي از محافظه كاران نفس ارائه اين لايحه را كاري مفيد و لازم ميبينند اما اين لايحه رااز نظر حقوقي مشكل تراش مي دانند. اين گروه در ساختار قدرت جايگاهي ندارد وهواداران آن بدون اينكه روشن بگويند تصويب يك چنين لايحه اي را باعث تغييري اساسي در ساختار تصميم گيري سياسي موجود نمي دانند. در مقابل جناح قدرتمند محافظه كاران ارائه وتصويب اين لايحه را تعرض به قانون اساسي ونهادهاي حكومتي و حتي راه صاف كن استبداد مي خوانند. وراي اختلافات موجود بين جناحهاي حكومتي بر سرلايحه تبيين اختيارات رئيس جمهوري وزارت ارشاد از يك نظر سنجي خبر مي دهد كه بيش از 80 در صد از نظر دهندگان خواستار افزايش اختيارات رئيس جمهوري هستند. اما اين تنها جناحهاي حكومتي نيستند كه بر سر اين لايحه اختلاف نظر دارند. بسياري از صاحب نظران برون از حكومت نيز اهميت و پي آمد اين لايحه را متفاوت ارزيابي ميكنند. در حاليكه دكتر محمد ملكي رئيس پيشين دانشگاه تهران خانه را از پاي بست ويران مي داند و بر اين باور است كه اين لايحه مشكلي را حل نمي كند. دكتر محمدملكي: چي را مي خواهد حل كند؟ چه مسئله اي پيش آمده كه آقاي خاتمي بعد از 5 سال و نيم كه با اين قانون اساسي به رياست جمهوري خودش ادامه داده امروز به اين فكر افتاده كه بياد يك همچه كاري بكند. چه دستگاه و چه مقامي نمي گذارد ايشان آن نظارت عاليه را كه براجراي قانون اساسي بايد داشته باشند، پيگيري كند؟ چه كساني نمي گذارند؟ مشكل ما به نظر من مشكل ريشه اي است. بيائيد شفاف صحبت كنيم. آنچه كه واقعيت دارد را بگوئيم. آن اين است كه اين قانون اساسي فعلي از روز اولي كه تصويب شد، با اشكال بود. بنابراين الان اين قانون مورد اعتراض است. شما ببينيد، آقاي خاتمي در شرايطي دارد قانون مي گذارد كه قانون اساسي را به اصطلاح من بزك اش بكند، كه الان از هر سو كه شما نگاه كنيد فرياد ها بلند است كه بايد اين قانون اساسي را به رفراندوم ملت بگذاريم. مردم اشكال دارند نسبت به اين قانون. ببينيم آيا ملت اصلا اين قانون اساسي را قبول دارد يا نه؟ با اين تضادهائي كه وجود دارد. فريدون زرنگار: دكتر صادق زيبا كلام استاد دانشگاه در تهران نگران آن است كه دادن اختيارات به رئيس جمهوري ميتواند با تغيير رئيس جمهور مساله ساز شود دكترصادق زيباكلام: ما بايستي كاري كه بكنيم كه اختيارات مجلس كه برگرفته از نمايندگان ملت است، آن را زياد تر كنيم. ما بايد كاري كنيم كه نهادهاي قدرت كه در قانون اساسي آمده، به ملت و به مردم پاسخگو باشند. ما بايد كاري كنيم كه مقام معظم رهبري و زيرمجموعه هاشان در مقابل عملكرد زير مجموعه ها به ملت پاسخگوباشند وقوه قضائيه و نيروي انتظامي به مردم ومجلس پاسخگو باشند. ما اينها را بايد جلو ببريم نه اينكه نگوئيم پس ما چگونه مي توانيم اختيارات رهبر را كم بكنيم يا آن حوزه هائي كه ايشان نفوذ دارند ما كم بكنيم، خوب بيائيم به جايش اختيارات رئيس جمهوري را زياد كنيم. بنده معتقدم اين از چاله در آمدن و افتادن به چاه است. ما بايد اختيارات مجلس شوراي اسلامي را زياد كنيم چون آن وقت ديگر نظام مورد تهديد قرار نمي گيرد كه اگر يك فرد داراي گرايش هاي استبدادي شد و داراي گرايش هاي مطلقه شد، آن وقت چه كنيم. لايد مي گوئيم حالا اختيارات رئيس جمهوري را ما كم مي كنيم چون رئيس جمهوري ما ديكتاتورمنش است. ما بايد به سمت وسوي راه حال هاي بلند مدت برويم نه دنبال راه حال هاي مقطعي كه امروز را به فرداي ما برساند. فريدون زرنگار: دكتر زيبا كلام از لزوم راه حلي درازمدت سخن مي گفت. در هر حال ناظران سياسي اين احتمال را مي دهند كه در هفته ها و ماه هاي آينده سر نوشت لايحه تبيين اختيارات رياست جمهوري چالش مهم جناح هاي حكومتي ايران بماند.

با گذشت حدود يك هفته از ارائه لايحه تبيين اختيارات رئيس جمهوري به مجلس شوراي اسلامي گفتگو بر سر آن همچنان موضوع سياسي روز است. برادر محمد خاتمي، رئيس جمهوري اسلامي، كه نيابت رياست مجلس را عهده دار است، گفت در مجلس براي رسيدگي به اين لايحه كميسيوني تشكيل خواهد شد. اصلاح طلبان ارائه اين لايحه را روزنه اي براي خارج شدن از بن بست سياسي نظام ارزيابي مي كنند. جناح قدرتمند محافظه كار ارائه وتصويب اين لايحه را تعرض به قانون اساسي ونهادهاي حكومتي و حتي راه صاف كن استبداد مي خواند. دكتر محمد ملكي، فعال ملي مذهبي و رئيس پيشين دانشگاه تهران، در مصاحبه با راديوآزادي مي گويد اين لايحه مشكلي را حل نمي كند. دكتر صادق زيبا كلام، استاد دانشگاه در تهران، در مصاحبه با راديوازادي ابراز نگراني مي كند كه دادن اختيارات به رئيس جمهوري ميتواند با تغيير رئيس جمهور مسئله ساز شود.
